The Court of Competition and Consumer Protection changed the ERO President decision regarding the settlement of value of annual adjustment of the stranded costs (so called LTC compensations) for 2008 for PGE Górnictwo i Energetyka Konwencjonalna S.A. Branch Zespół Elektrowni Dolna Odra

The Management Board of PGE Polska Grupa Energetyczna S.A. ("PGE") discloses that on November 12, 2012 the District Court in Warsaw - Court of Competition and Consumer Protection (“CCCP”) re-examined the case of annual adjustment of the stranded costs for PGE Zespół Elektrowni Dolna Odra S.A. (currently PGE Górnictwo i Energetyka Konwencjonalna S.A. – Branch Zespół Elektrowni Dolna Odra) for 2008. CCCP re-examined the case after the Appeal Court in Warsaw repealed CCCP verdict of May 26, 2010 and remitted the case for re-examination on March 12, 2012. PGE informed about that in its current report no 10/2012 dated March 12, 2012. As a result of re-examination CCCP issued a verdict, which changed the decision of the ERO President of July 31, 2009 in accordance with the appeal filed by the generator. The claim value in the ZEDO case for 2008 amounts to PLN 42.4 million. The CCCP verdict is not final and binding. The ERO President is entitled to file an appeal with the Appeal Court.
