Obtaining the decisions on the permit to erect and use artificial islands, structures and devices in Polish maritime areas for projects involving construction of offshore wind farms

The Management Board of PGE Polska Grupa Energetyczna S.A. (”PGE”, the ”Company”) discloses that on August 9, 2023 the Company received the decisions of the Minister of Infrastructure on granting of permits to erect and use artificial islands, structures and devices in Polish maritime area (exclusive economic zone) (the „Decisions”) identified as:

- area 43.E.1 for the construction of an offshore wind farm requested by PGE Baltica 4 sp. z o.o. PGE holds 55.04% of shares in PGE Baltica 4 sp. z o.o., and remaining 44.96% of shares is held by TAURON Polska Energia S.A. Capacity of the planned offshore wind farm which would be constructed on the basis of the obtained permit amounts to approx. 1 GW.

- area 44.E.1 for the construction of an offshore wind farm requested by Elektrownia Wiatrowa Baltica 9 sp. z o.o. PGE holds 100% of shares in Elektrownia Wiatrowa Baltica 9 sp. z o.o. Capacity of the planned offshore wind farm which would be constructed on the basis of the obtained permit amounts to approx. 1 GW.

- area 60.E.3 for the construction of an offshore wind farm requested by Elektrownia Wiatrowa Baltica 1 sp. z o.o. PGE holds 100% of shares in Elektrownia Wiatrowa Baltica 1 sp. z o.o. Capacity of the planned offshore wind farm which would be constructed on the basis of the obtained permit amounts to approx. 1.2 GW.

- area 60.E.4 for the construction of an offshore wind farm requested by Elektrownia Wiatrowa Baltica 5 sp. z o.o. PGE holds 66.19% of shares in Elektrownia Wiatrowa Baltica 5 sp. z o.o., and remaining 33.81% of shares is held by ENEA S.A. Capacity of the planned offshore wind farm which would be constructed on the basis of the obtained permit amounts to approx. 0.56 GW.

- area 45.E.1 for the construction of an offshore wind farm requested by Elektrownia Wiatrowa Baltica 2 sp. z o.o. PGE holds 50% of shares in Elektrownia Wiatrowa Baltica 2 sp. z o.o, and remaining 50% of shares is held by Ørsted. Capacity of the planned offshore wind farm which would be constructed on the basis of the obtained permit amounts to approx. 0.2 GW.

Total potential capacity of the above mentioned projected wind farms will amount to approx. 3.9 GW.

The Decisions are not final. Within 14 days from the delivery of the Decisions, the parties of the proceeding are entitled to send request to the Minister of Infrastructure for the re-examination of the case. The Company’s intention is to disclose through the current reports only the occurrence of circumstances which would prevent obtaining the finality for the Decisions.
