Court remitted bankruptcy proceedings of subsidiary of PGE Dystrybucja S.A.

Contents of the report

The Management Board of PGE Polska Grupa Energetyczna S.A. (“PGE”) discloses that on July 6, 2012 the District Court in Białystok - Commercial Court, 8th Commercial Division (the “Court”) remitted proceedings in case of petition in bankruptcy with the possibility of composition and approval of initiation of the recovery proceeding requested by EKTO Sp. z o.o. with its registered office in Białystok (the „Subsidiary”). The court remitted proceedings due to lack of rationale in connection with the repayment of receivables of the Subsidiary and decision of the Subsidiary to withdraw the petition in bankruptcy. The Court decree will become final and binding in two weeks’ time.

The Management Board of PGE informed about the Subsidiary’s petition in bankruptcy with the possibility of composition and approval of initiation of the recovery proceeding in the current report no. 30/2012 dated June 22, 2012.

Legal ground: § 5 section 1 p. 24 and § 30 p. 8 of the Regulation of the Polish Minister of Finance of February 19, 2009 on current and periodic information published by issuers of securities and on conditions under which such information may be recognized as being equivalent to information required by the regulations of law of a state which is not a member state.
